Rules for joining the Community 1. Digital FIAT Community 1.1. The digital FIAT Community (“Community”) is a program for the users of FIAT “Fabbrica Italiana Alta Tecnologia” products by T-Logic. It was devised in order to provide the Community members with information and services from the Web site www.fiatbytlogic.it (“Site”). 1.2. The service is offered by Life Tool Technologies S.p.A. (“Life Tool Technologies”), Via Barilatti, 5/7 – 60127 Ancona, Italy. 2. Requirements for joining the Community 2.1. Membership is personal and non-transferable. 2.2. In order to join the Community you need not have a product from the FIAT digital line. A product can be used only once for warranty extension. 2.3. Each individual can join the Community only once. 2.4. Membership starts from acceptance of registration with the Community. You must read and accept these Rules for joining the Community to register. 2.5. Unless otherwise stated by applicable laws, underage individuals must be authorised by either their parents or guardian to join the Community. 2.6. After registration, the Member will receive a confirmation of his/her registration and a summary of the details entered by e-mail. 3. Services for the Members 3.1. A Member can profit from the different services and offers posted on the Site. Said services and offers are supplied according to the terms and conditions stated on the Site. 3.2. In order to profit from the services, you need to read and accept any further terms and conditions on the services as stated on the Site before using the service. 3.3. Some of the services supplied are charged separately or are destined to specific countries and/or languages or are related to only some products, geographical areas or other aspects - as stated on the Site from time to time. 3.4. Some of the services supplied inside the Community may be destined to adults exclusively (not underage individuals) in compliance with applicable laws. 3.5. Life Tool Technologies reserves the right to change these Rules for joining the Community, the legal notes, the privacy procedure and other terms and conditions related to the services at any time without prior notice. It also reserves the right to inform the Members by posting an updated version of the document concerned on the Site. Said changes will be deemed approved if the Member profits from his/her Community membership and/or any services after the changes are made known, unless written objections have been submitted within one month of the date when the changes are made known. 4. Passwords and safety. Use of the Community 4.1. The Member undertakes to keep the information on his/her Community membership updated, including - by way of example - his/her e-mail and postal addresses, in order for the services to be supplied accurately and on time. 4.2. Each Member undertakes to stand surety for Life Tool Technologies in the event proceedings are started by third parties against Life Tool Technologies owing to the Member having submitted inaccurate information on joining the Community. 4.3. When sending material to any site or server of the Community or for any of the Community’s services: a) the Member undertakes not to use the Community’s services for unlawful or unauthorised purposes that: (1) may infringe upon intellectual property rights such as patent, trademark, trade secret and confidentiality rights and copyrights; (2) may be libellous or abusive towards any individual; (3) may cause damage to property or people or anyway bother third parties; (4) may infringe upon third parties’ privacy rights; (5) include pornographic, obscene or blasphemous material; (6) hint at or encourage illegal activities; and b) the Member undertakes to do his/her best to scan and remove any viruses or other contaminating or destructive features before sending any material; and c) in supplying material to be made available to the public, the Member warrants that he/she either is the owner or has the unlimited right to supply it to Life Tool Technologies. The Member also warrants that Life Tool Technologies is allowed to always publish said material all over the world free of charge and/or to change or include any concepts from the material into Fiat by T-Logic products without incurring any responsibility, d) the Member undertakes not to start any proceeding against Life Tool Technologies related to the material sent by it and undertakes to indemnify Life Tool Technologies in the event any third party should start proceedings against Life Tool Technologies related to the material sent by it. e) Underage Members must obtain an authorisation from their parent(s) or guardian(s) before sending any material to Life Tool Technologies and accepting any Rules on the Community services. The Community reserves the unchallengeable right to remove any materials or contents without prior notice, should a Member act not in compliance with the above. 4.4. Life Tool Technologies will deem that the actions carried out during a work session started with a Member’s valid identification number o password have been carried out by that Member, unless clear evidence to the contrary is shown. 4.5. The password entered on registering with the Community is strictly personal and the Member undertakes not to spread it or give it to other people. 4.6. In the event a Member’s password is compromised or the Member learns about any unauthorised use of the account or other safety breaches, the Member shall promptly inform Life Tool Technologies thereof. Such communication will shift the responsibility for any unauthorised use to Life Tool Technologies. The Member can inform Life Tool Technologies either by telephone (071.890151) or by e-mail (info@lifetooltech.it). The Member can change the password by him/herself by accessing his/her personal data on the Community site. 4.7. The Members undertake never to use other individuals’ accounts without the owner’s authorisation. Life Tool Technologies is entitled to terminate any Member’s membership to the Community without prior notice in the event said Member either infringes upon the above-mentioned safety rules or uses the Community’s services unlawfully. 4.8. Life Tool Technologies is entitled to supply Web sites or WAP-enabled sites and/or third parties’ services with different settings or connections such as bookmarks. As said settings, sites and/or third parties’ services are not controlled by Life Tool Technologies, access to such settings, sites and/or services takes place in an "AS IT IS” and “AS AVAILABLE” status. Life Tool Technologies refuses all responsibility for said settings, sites and/or services, including, by way of example and without limitation, contents and functionality. 5. Membership termination 5.1. The Member is entitled to withdraw from membership to the Community at any time and consequently annul his/her consent to the use and processing of his/her personal data by either writing to the address shown in Clause 1.2 or sending an e-mail to info@lifetooltech.it, stating the following data on the Member: full name, address, nickname for registering with the Community, e-mail address. 5.2. Life Tool Technologies is entitled to either annul any membership to the Community or to fully or partially disrupt access to the Community’s services, with or without prior notice, in the event a Member infringes upon any provision of these Rules for joining the Community, the legal notes, the privacy procedure and other terms and conditions on the services, or in the event a Member submits substantial misrepresentations or acts inappropriately. Life Tool Technologies is entitled to terminate membership also in the event the Community is disrupted or replaced with a different program, in Life Tool Technologies’ absolute discretion. Life Tool Technologies is also entitled to terminate a Member’s membership in the event said Member has not used any of the Community’s services for 4 years. 5.3. Membership will expire when Life Tool Technologies sends to the individual concerned a notice on the termination of his/her Community membership. Life Tool Technologies will send such notice to the postal or e-mail address of the person concerned as specified by the Member. Life Tool Technologies is not required to submit such notice and the termination will become effective without prior notice in the event the Member has not submitted the above-mentioned information or the information is not accurate. 5.4. Should Life Tool Technologies terminate a Member’s membership to the Community, all the rights (if any) related to the services and offers on the Community’s site will either expire or come to an end together with the termination. 6. Limitation of liability and limited warranty 6.1. Except as specified by the following provisions, Life Tool Technologies does not warrant that the Web pages will not be subject to disruptions or mistakes. 6.2. Life Tool Technologies undertakes to ensure a warranty for the Community’s services within the scope specified by the mandatory rules of applicable regulations. 6.3. Life Tool Technologies shall not be responsible for the temporary unavailability of the Community’s site. Life Tool Technologies does not assume any responsibility for any delay, data loss or damage during transmission from the Web site to the Member. 6.4. Life Tool Technologies excludes all warranties of any nature related to the condition, suitability, availability, accuracy, reliability of the product, suitability of the product to its normal use, and/or non-falsification of the contents posted on the club nokia site, the equipment belonging to the user, the Internet, public lines and/or operators’ networks. 6.5. Within the scope specified by applicable regulations and in compliance with these Rules on joining the Community, Life Tool Technologies’ responsibility towards you shall be limited to an amount corresponding to the sale price of the most expensive Material or Service you purchased from the Community. Within the scope specified by mandatory rules, this limitation of liability is not applicable in the event of death, damage to people due to Life Tool Technologies’ negligence or responsibilities deriving from Life Tool Technologies’ gross negligence or wilful default. 6.6. Within the scope specified by applicable regulations, Life Tool Technologies refuses all responsibility of a contractual or non-contractual nature or other nature for: a) loss of profits, business income, goodwill, given or estimated savings; or b) any indirect or consequential damage or loss. 7. Miscellaneous provisions 7.1. Life Tool Technologies is entitled to change, modify or refuse access to the Community’s services at any time with or without prior notice and without any responsibility, unless otherwise specified in the other relevant general conditions of the service concerned. 7.2. The invalidity of any of these provisions shall not affect the validity of the remaining provisions. The invalid provision shall be replaced with a valid provision whose effect and objective are as close as possible to these Rules for joining the Community. 7.3. These Rules for joining the Community shall neither limit nor exclude the application of any Community member’s peremptory right. In compliance with and to the purposes of Articles 1341 and 1342 of Italian Civil Code, the Member expressly approves the following Articles: Article 4 - Passwords and safety. Privacy Policy Web Site www.fiatbytlogic.it By means of this page Life Tool Technologies (Life Tool Technologies S.p.A., Via Barilatti, 5/7, 60127 Ancona, Italy), the owner of data processing, intends to describe how its own Web site is to be handled as concerns the processing of personal data from the customers/users accessing the site. In compliance with Article 13 of Italian Legislative Decree No. 196/2003, Life Tool Technologies hereby informs all customers/users that their personal data sent to the Web site or submitted on registering with the FIAT Community will be stored in Life Tool Technologies’ database exclusively for the time needed and, if necessary, will be processed and used to implement the program and the services required. Whenever customers/users wish to use specific services, special notifications will be supplied to them and approvals will be required, if necessary, in order for their own personal data to be processed. Navigation data The computer systems and software procedures used to operate this Web site acquire - during ordinary operation - personal data whose transmission is inherent in the use of Internet communication protocols. This information is not collected in order to be associated to identified users, but - owing to its own nature - it could make it possible to identify the users, if processed and associated to third parties’ data. This can be done exclusively following an express request from the Judicial Authority. This data category comprises IP addresses or computer domain names used by the users connected to the site, uniform resource identifiers for required resources, the time of the request, the method used to submit the request to the server, the size of the file received in reply, the numeric code stating the status of the reply given by the server (success, error etc) and other parameters on the operating system and the user’s computer environment. This data makes up the connection log. This data can be used by Life Tool Technologies exclusively in order to acquire anonymous statistical information on how the site is used and to make sure of its proper operation. The connection log is subsequently made available to the Judicial Authority and is shown only following an express request. Data supplied by the user voluntarily The express and voluntary optional submission of e-mail messages to the addresses stated on the Web site entails the subsequent acquisition of the personal data supplied such as, by way of example, the sender’s e-mail address used by Life Tool Technologies to reply to the customer’s/user’s requests. Cookies No such personal data from the users is acquired by the Web site. No cookies are used to transmit information of a personal nature. The use of session cookies (that are not stored persistently in the user’s computer and disappear as soon as the browser is closed) is strictly limited to the transmission of the session identifiers (made up of random figures generated by the server) needed to make it possible to explore the site safely and efficiently. Thanks to the session cookies used in this site, there is no need to use other techniques that may prejudice the confidentiality of the users navigating the site. Also, they do not allow any acquisition of the user’s identifying personal data. Data submission Except for the statements on navigation details, the users are free to submit their personal data from time to time requested by Life Tool Technologies. Nevertheless, failure to submit it may make it impossible to supply the services required. Safety of information Special safety measures are followed in order to prevent any loss of data, unlawful or improper use and unauthorised access. We wish to inform you that Internet communications such as e-mail messages may cross several countries before final delivery. Life Tool Technologies cannot assume responsibility for any unauthorised access or loss of personal information outside its control. Rights of persons concerned The persons the personal data refers to are entitled at any time to demand a confirmation of whether said data exists or not, to know its content and origin, to check its accuracy, and to ask for it to be supplemented or updated or amended, in compliance with Art. 7 of Italian Legislative Decree No. 196/2003. In compliance with said Article they can demand the cancellation, transformation in anonymous form or blockage of any data processed unlawfully. In any case they are also entitled to oppose - for legitimate reasons - its processing by writing to Life Tool Technologies S.p.A., Via Barilatti, 5/7, 60127 Ancona, Italy. Responsibility of data processing A detailed list of the persons responsible for data processing and of third parties to whom the customers’ personal data may be communicated is available either at Life Tool Technologies’ premises or upon written request. Life Tool Technologies reserves the right to change or amend at any time this Privacy Policy, especially if new industry regulations have become effective. The changes will become effective 15 days after their publication in the Web site. Art. 7. Right of access to personal data and other rights 1. The person concerned is entitled to demand both a confirmation of whether personal data about him/her exists or not (although it has not been registered yet) and its communication in a intelligible form. 2. The person concerned is entitled to know: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied when the processing is carried out by electronic tools; d) the essential data identifying the owner, the persons responsible and the appointed representative in compliance with Art. 5, Par. 2; e) the persons and categories to whom the personal data may be communicated or who may learn about it as appointed representatives in the State territory, persons responsible or in charge. 3. The person concerned is entitled to demand: a) that the data be updated, amended or, should he/she be interested, supplemented; b) that the data processed unlawfully be cancelled, transformed in anonymous form or blocked, including those whose storage is not necessary in relation to the purposes for which the data was collected or subsequently processed; c) a statement that the operations indicated under a) and b), including their content, have been made known to those to whom the data has been communicated or released, except in the case of this being found to be impossible or requiring the use of means which are clearly disproportionate to the protected right; 4. The person concerned has the right to completely or partially oppose: a) for legitimate reasons, the processing of personal data regarding him/her, even if relevant to the aims of its collection; b) the processing of personal data regarding him/her either for the dispatch of advertising or direct-sales material or in view of market research or commercial communications.
